PingPro allows you to access its websites (www.pingpro.com) and all the features in them on certain terms and conditions specified below. By accessing or subscribing to any part of these sites, you are explicitly agreeing to the terms and conditions below. These terms and conditions were updated as on October 1, 2008, and PingPro reserves all rights to change, modify or alter these terms and conditions at any point of time with or without notifying existing users and subscribers. If you do not agree to the new terms and conditions you should not use the pingpro.com and its features.
Authorization
By setting up a monitoring plan, you agree that you own or have written authorization to use our service from the legal owner of the URL(s) or IP address(es) to be monitored by PingPro.
Disclaimer
THIS SERVICE IS PROVIDED "AS IS" AND ANY EXPRESSED OR IMPLIED WARRANTIES, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE ARE DISCLAIMED. IN NO EVENT SHALL WE BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES (INCLUDING, BUT NOT LIMITED TO, PROCUREMENT OF SUBSTITUTE GOODS OR SERVICES; LOSS OF USE, DATA, OR PROFITS; OR BUSINESS INTERRUPTION) HOWEVER CAUSED AND ON ANY THEORY OF LIABILITY, WHETHER IN CONTRACT, STRICT LIABILITY, OR TORT (INCLUDING NEGLIGENCE OR OTHERWISE) ARISING IN ANY WAY OUT OF THE USE OF THIS SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGE.
Termination of Service
We reserve the right to terminate service for any customer at any time, at our sole discretion.
30-Day Money Back Guarantee
Each of PingPro paid plans carries a 30-day unconditional money back guarantee. If you are not completely satisfied with our services or support within the first 30 days, you will be given a full refund of the fees paid in advance (excluding setup fees) upon plan cancellation.
The following services do not qualify for the 30 Day Money Back Guarantee: additional items and services; sms package purchased, items and services ordered through the affiliate program; setup fees and overage fees. All cancellations must be received in writing as per the deadlines indicated; regular mail, e-mail and fax notifications are acceptable. Phone requests will not constitute acceptance of any cancellation. If sending by e-mail you must direct the cancellation to billing@pingpro.com. No other e-mail address will be constituted as a cancellation and therefore would not be deemed cancelled.
Refund Policy
Full Refunds are only available in accordance with the 30 Day Money Back Guarantee. Refunds will be provided in the same payment method of the original payment. There are no refunds offered or promised after 30 days. There are no refunds and/or credits offered if you (the customer) receive overdraft charges from your bank.
Billing Cycles (Terms)
PingPro offers two Billing Cycles (terms) for monitoring plans: Monthly and Yearly (12 months). The Billing Cycle begins on the Plan Activation Date.
You may elect to change your Billing Cycle at any time; however, the new Billing Cycle will only take effect at the time of the next plan renewal.
All additional purchased items are non-refundable.
Privacy Policy
If you have supplied us with personal and financial information, (such as your credit card or bank details) in a transaction, e.g. purchasing any of our paid plans, we will use this information in the normal conduct of our business relationship with you.
Financial information is used to bill you for the products and services you order from us.
This information will be used to support your account and also to inform you about new products and services that we provide or to provide details of our services that we believe may be of interest to you.
Note: We will not disclose or share your personal and financial information with any third party without your notice and consent.
Credit Card Disputes/ChargeBack's
PingPro has a zero tolerance policy for chargeback’s. Any customer who disputes a credit card payment is subject to a suspension and/or account termination at PingPro discretion.
